Terms of Service

1. Introduction

Welcome to ChatOman. These Terms of Service (“Terms”) govern your access to and use of ChatOman’s website at chatoman.co (the “Website”) and the artificial intelligence chatbot services provided through the Website or any platform where our chatbot is embedded (the “Chatbot Services”). By accessing or using the Website or Chatbot Services, or by starting a plan, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Website or Chatbot Services.

2. Eligibility and acceptance

You affirm that you are of legal age to enter into a binding agreement and that you have the authority to bind any business or organisation you represent. The Website and Chatbot Services are intended for businesses and individuals of legal age. By using the service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

3. The service

ChatOman provides a done-for-you, bilingual (Arabic and English) AI chatbot service. We build, train, host, and maintain a chatbot for your business. The message allowances, AI Actions, and features available to you are defined by the plan you select on the pricing page. Standard setup is typically completed within 24 to 48 hours of our receiving your business details. Founding clients go live within seven days, as described in Section 5.

4. Plans, billing, and renewal

Plans are billed monthly or annually; annual plans receive two months free. Setup fees apply per plan and are waived on annual and founding plans. Subscriptions renew automatically at the end of each billing term unless you cancel before the renewal date, and you remain responsible for the applicable fees for each renewed term. ChatOman may revise its fees for future billing terms by giving reasonable prior notice, with any change taking effect from your next renewal; rates locked under the founding offer remain unchanged for their twelve-month term. All prices are stated in Omani Rial (OMR) and are exclusive of any applicable taxes or charges.

5. Founding offer and service guarantee

Founding clients receive free setup, a free first month, and a rate locked for twelve months from the date of signup. We will have your chatbot live within seven days of receiving all of the business materials we request from you; if we fail to do so, your next month is provided free of charge. The seven-day period begins only once you have provided all requested materials in full. This guarantee is limited to the provision of one free month and does not apply to delays caused by you, by incomplete information, or by third-party platform outages. Founding terms are available only to clients who sign up while the founding offer is active.

6. Cancellation and refunds

You may cancel your subscription at any time. Following cancellation, your access continues until the end of the current paid period, after which the service and any associated chatbot will be deactivated. Except where required by applicable law, all fees are non-refundable, and no refunds or credits are provided for partial billing periods, unused allowances, or setup fees once setup work has commenced.

7. Client responsibilities and warranties

You agree to provide accurate, complete, and lawful information and materials for the configuration and training of your chatbot. You represent and warrant that you own, or have all necessary rights and permissions to use, the content you provide to us, and that such content does not infringe the rights of any third party or violate any law. You are solely responsible for your use of the chatbot in your business, for the interactions it has with your customers, and for your compliance with all laws applicable to your business.

For any chatbot deployed on your own website or platforms, you are the controller of the personal data collected from your customers, and ChatOman acts as a service provider that processes such data on your behalf and on your instructions. You are responsible for providing your customers with any required privacy notices, for having a lawful basis to collect and process their personal data, and for your own compliance with applicable data-protection laws. ChatOman’s handling of personal data is described in our Privacy Policy.

8. Use of the Chatbot Services

The Chatbot Services provide automated information and assistance. While we strive for accuracy and reliability, we do not guarantee that responses will be error-free, complete, or current, as responses are generated by artificial intelligence and may not capture every nuance or address every complex or specific situation. Information provided by the Chatbot Services does not constitute professional, legal, financial, or medical advice; you should consult a qualified professional for advice specific to your circumstances. For critical or sensitive matters, please contact a human representative.

9. Acceptable use

You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Website and Chatbot Services for purposes related to ChatOman’s services. You agree not to use the Website or Chatbot Services for any unlawful, harmful, deceptive, or abusive purpose; to attempt to gain unauthorised access to any part of the Website, the Chatbot Services, or any related systems or networks; to transmit any virus, worm, or other harmful or destructive code; to interfere with or disrupt the Website or Chatbot Services; or to communicate in an abusive, harassing, threatening, or discriminatory manner.

10. Intellectual property

All content and intellectual property on the Website and within the Chatbot Services, including text, graphics, logos, designs, and software, are the property of ChatOman or its licensors and are protected by applicable intellectual property laws. You retain ownership of the business content you provide to us, and you grant ChatOman a licence to use that content solely to provide, maintain, and improve your service. You may not use, reproduce, distribute, or create derivative works from ChatOman’s content without our express written permission.

11. Third-party services

ChatOman relies on third-party platforms, including Chatbase and other automation, scheduling, and communication tools, to deliver the Chatbot Services. ChatOman does not control the infrastructure, availability, uptime, or core functionality of these platforms and is not liable for any outage, error, or change made by them. Your use of the service is also subject to the terms and policies of these third-party providers where applicable.

12. Service availability and force majeure

We aim to provide a reliable service but do not warrant that the Website or Chatbot Services will be available without interruption. ChatOman is not liable for any failure or delay in performance caused by events beyond its reasonable control, including third-party platform failures, internet or telecommunications outages, acts of government, or other events of force majeure.

13. Suspension and termination

ChatOman may suspend or terminate your access to the Website or Chatbot Services, in whole or in part, without liability, if you fail to pay applicable fees, breach these Terms, or use the service in a manner that may cause harm to ChatOman, its providers, or any third party. You may stop using the service at any time in accordance with Section 6.

14. Disclaimer of warranties

The Website and Chatbot Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ChatOman does not warrant that the Website or Chatbot Services will be uninterrupted, secure, accurate, or error-free.

15. Limitation of liability

To the maximum extent permitted by applicable law, ChatOman shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Website or Chatbot Services. In all cases, ChatOman’s total aggregate liability shall not exceed the total amount you paid to ChatOman in the thirty days immediately preceding the event giving rise to the liability.

16. Indemnification

You agree to indemnify and hold harmless ChatOman and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Website or Chatbot Services, the content you provide, or your violation of these Terms or any applicable law.

17. Changes to these Terms

ChatOman may modify or revise these Terms at any time. We will indicate changes by updating the “Last updated” date above and, where the changes are material, by posting a prominent notice on the Website. Your continued use of the Website or Chatbot Services after any change takes effect constitutes your acceptance of the revised Terms.

18. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Sultanate of Oman, without regard to its conflict-of-law principles. The courts of the Sultanate of Oman shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Chatbot Services.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. ChatOman’s failure to enforce any right or provision shall not constitute a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; ChatOman may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms constitute the entire agreement between you and ChatOman regarding the Website and Chatbot Services and supersede any prior agreements.
